How to apply the ESS rules to shares / rights that qualify for deferred taxation
While the default position is that a discount on an ESS is taxed upfront, the structure of many schemes allows for deferred taxation. We work through the rules applying to tax deferred schemes, including how to qualify for deferred tax treatment and what happens if a deferred taxing point is triggered.
