Investing in property via an SMSF can offer significant tax advantages however there are complex superannuation (SIS) rules that need to be carefully followed and getting things wrong can be costly to trustees.
In this session we will cover the compliance obligations and responsibilities associated with holding investment properties within an SMSF. It is important that trustees clearly understand the additional rules and obligations before investing as they can be a surprise to clients who have previously invested in property outside of superannuation.
We will consider the following:
- Getting the acquisition right
- The business real property (BRP) definition and when this is relevant
- The requirements for an SMSF to be able to borrow
- When the property needs work done – repairs, improvements and changing the property in its entirety
- Arm length issues
- Annual valuation obligations and ensuring a smooth audit.
